1. Acceptance of Terms
By accessing or using BCW Wallet ("the Platform", "we", "our", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use our platform.
These Terms constitute a legally binding agreement between you ("User", "you") and BCW Wallet. By creating an account, you confirm that you have read, understood, and accepted these Terms in their entirety.
Note: BCW Wallet is an independent platform and is not affiliated with Blockchain.com, Bitcoin.com, Coinbase, or any other cryptocurrency service provider.
2. Eligibility
To use BCW Wallet, you must meet the following eligibility requirements:
- Be at least 18 years of age or the legal age of majority in your jurisdiction, whichever is higher.
- Have the legal capacity to enter into a binding contract in your jurisdiction.
- Not be a resident of a jurisdiction where cryptocurrency services are prohibited by law.
- Not be subject to any sanctions, embargoes, or financial restrictions imposed by international bodies.
- Provide accurate, current, and complete information during registration and at all times.
Restricted Jurisdictions: BCW Wallet does not provide services to residents of countries subject to comprehensive sanctions, including but not limited to North Korea, Iran, Cuba, Syria, and the Crimea region.
3. Account Registration
To access the full features of BCW Wallet, you must create an account. You agree to:
- Provide accurate and truthful information during registration.
- Keep your login credentials (email and password) strictly confidential.
- Notify us immediately of any unauthorized access to your account.
- Complete identity verification (KYC) as required by our compliance policies.
- Maintain only one account per individual — multiple accounts are prohibited.
BCW Wallet reserves the right to refuse account creation or suspend existing accounts at its sole discretion, particularly in cases of fraud, policy violations, or regulatory concerns.
4. Services Provided
BCW Wallet provides the following digital asset management services:
- Custodial Bitcoin Wallet: Secure storage and management of Bitcoin (BTC) balances.
- Send & Receive: Ability to send and receive Bitcoin to/from external addresses.
- Deposits: Deposit Bitcoin from supported exchanges and external wallets.
- Withdrawals: Withdraw Bitcoin to external wallets or fiat currency via supported payment methods.
- Balance Tracking: Real-time display of BTC balance and fiat equivalents.
- Transaction History: Comprehensive log of all account transactions.
BCW Wallet is a custodial service. This means your Bitcoin balance is held and managed on our platform. We are responsible for the security of funds held in your BCW account.
5. User Obligations
As a user of BCW Wallet, you agree to the following obligations:
- Use the platform only for lawful purposes and in compliance with all applicable laws and regulations.
- Complete all required identity verification steps promptly when requested.
- Keep your contact information and account details up to date.
- Report any suspicious activity, security breaches, or unauthorized transactions immediately.
- Not attempt to circumvent, bypass, or disable any security features of the platform.
- Accept sole responsibility for the tax implications of your cryptocurrency transactions in your jurisdiction.
6. Prohibited Activities
The following activities are strictly prohibited on BCW Wallet:
- Money laundering, terrorist financing, or any other illegal financial activity.
- Using the platform to process proceeds from illegal activities.
- Creating fake, duplicate, or fraudulent accounts.
- Attempting to hack, reverse-engineer, or exploit the platform.
- Using automated bots or scripts to access the platform.
- Providing false identity documents during KYC verification.
- Engaging in market manipulation, pump-and-dump schemes, or wash trading.
- Violating the intellectual property rights of BCW Wallet or third parties.
Violations of these prohibited activities may result in immediate account suspension, asset freezing, and reporting to relevant law enforcement authorities.
7. Transactions and Fees
All transactions on BCW Wallet are subject to the following conditions:
- Transaction Fees: BCW Wallet may charge fees for withdrawals and certain transactions. Fees are disclosed prior to transaction confirmation.
- Network Fees: Bitcoin network (miner) fees are separate from platform fees and are subject to network conditions.
- Irreversibility: All confirmed Bitcoin transactions are irreversible. BCW Wallet cannot reverse a transaction once it has been submitted to the Bitcoin network.
- Processing Times: Withdrawal processing times vary depending on verification status, withdrawal method, and network congestion.
- Minimum Amounts: Minimum transaction amounts apply and are displayed within the platform.
8. Risk Disclosure
Cryptocurrency investments and services carry significant risks. By using BCW Wallet, you acknowledge and accept the following risks:
- Market Volatility: The value of Bitcoin and other cryptocurrencies can fluctuate dramatically in short periods. You may lose some or all of your funds.
- Regulatory Risk: Cryptocurrency regulations are evolving. Changes in law may affect the availability of our services in your jurisdiction.
- Technical Risk: Software bugs, network attacks, or infrastructure failures may temporarily affect platform availability.
- Cybersecurity Risk: Despite our security measures, no system is completely immune to cyberattacks or data breaches.
- User Error: Sending cryptocurrency to incorrect addresses is irreversible. Users bear full responsibility for transaction accuracy.
Past performance does not guarantee future results. Never invest more than you can afford to lose. BCW Wallet does not provide financial, investment, or tax advice.
9. Limitation of Liability
To the maximum extent permitted by applicable law, BCW Wallet and its officers, directors, employees, and agents shall not be liable for:
- Any indirect, incidental, special, consequential, or punitive damages.
- Loss of profits, revenue, data, or goodwill.
- Damages resulting from unauthorized access to your account due to your failure to protect your credentials.
- Losses resulting from the inherent volatility of cryptocurrency markets.
- Service interruptions caused by third-party infrastructure failures or force majeure events.
Our total liability to you for any claim shall not exceed the total fees paid by you to BCW Wallet in the 12 months preceding the claim.
10. Account Suspension and Termination
BCW Wallet reserves the right to suspend or terminate your account under the following circumstances:
- Violation of these Terms of Service.
- Suspected fraudulent, illegal, or suspicious activity.
- Failure to complete required identity verification within the specified timeframe.
- Receipt of a valid legal order requiring account restriction.
- Prolonged inactivity (accounts inactive for more than 24 months may be subject to closure).
In cases of account suspension due to policy violations or legal requirements, BCW Wallet may be unable to immediately release funds pending investigation. We will communicate the status and resolution timeline to the extent permitted by law.
11. Intellectual Property
All content on BCW Wallet — including but not limited to text, graphics, logos, user interface design, software, and code — is the exclusive property of BCW Wallet and is protected by applicable intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, or commercially exploit any content from BCW Wallet without express written permission from us.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the European Union and, where applicable, the laws of Estonia, without regard to its conflict of law provisions.
Any disputes arising from or relating to these Terms or the use of BCW Wallet shall be subject to the exclusive jurisdiction of the competent courts of Tallinn, Estonia. Users who are consumers in the EU may also have recourse to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
